Terms of Service

Last updated: September 21, 2026

1. Acceptance of Terms

By accessing or using Dryft's relet matching and coordination services, you agree to be bound by these Terms of Service. If you do not agree, you may not use our platform or services.

2. Description of Service

Dryft operates as an independent matching and coordination platform. We facilitate the transfer ("reletting") of existing residential leases by sourcing incoming tenants on behalf of outgoing tenants. Dryft is not a property management company, landlord, or real estate broker. We do not hold liability for the physical property, lease terms, or the final approval of any applicant by the property manager.

3. User Responsibilities

As an outgoing tenant, you agree to provide accurate and complete information regarding your lease, property manager, and property rules. You acknowledge that you remain legally and financially responsible for your lease obligations until the property manager officially executes the relet agreement with the incoming tenant.

4. Installment Payment Authorization

If you select the installment payment plan, you authorize Dryft to charge your payment method on file each month for the agreed installment amount until the total relet fee is paid in full or your move-out date is reached, whichever occurs first. You are responsible for maintaining a valid, working payment method on file for the full duration of the installment period.

5. Failed or Canceled Payment Method

If an installment charge fails for any reason (including, but not limited to, a declined, canceled, or closed payment method), you remain obligated to pay the full remaining balance of the relet fee. Dryft may attempt to recharge the payment method on file, request an updated payment method from you, or declare the entire unpaid balance immediately due and payable. Dryft reserves the right to pursue collection of any unpaid balance by any lawful means, including referral to a collection agency or legal action. You agree to reimburse Dryft for all reasonable costs incurred in collection, including reasonable attorney fees, to the extent permitted by law.

6. Non-Cancelable Installments

The installment plan is non-cancelable once initiated, except as explicitly provided under the Refund Guarantee in Section 2 of our Service & Refund Agreement.

7. Limitation of Liability

Dryft does not guarantee that the property manager will approve the incoming tenant's application. To the maximum extent permitted by law, Dryft shall not be liable for any indirect, incidental, or consequential damages, including but not limited to lost rent, property damage, eviction notices, or fees incurred from the property manager, arising from your use of the service.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.
